These Terms of Service ("Terms") form a legally binding agreement between you ("you" or "your") and the provider of Browser Recorder ("Browser Recorder", "we", "us" or "our") and govern your access to and use of the Browser Recorder Chrome extension, the browserrecorder.com website, and any related features, paid licences and services (together, the "Services").

By installing, accessing or using the Services, or by purchasing a licence, you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree to these Terms, please do not install or use the Services.

If you are using the Services on behalf of a company or other organisation, you represent that you have authority to bind that entity to these Terms, in which case "you" refers to that entity.

Who We Are

The Services are provided by Yuliya Kryshyna, a sole proprietorship (jednoosobowa działalność gospodarcza) registered in the Central Registration and Information on Business (CEIDG) in Poland, NIP 5273173624, with a registered address at ul. Jaktorowska 8/33, 01-202 Warszawa, Poland (referred to as "we", "us" or the "Provider"). You can reach us using the contact details at the end of these Terms.

The Service

Browser Recorder is a Chrome browser extension that lets you record your screen, browser tabs or windows, with optional microphone audio and camera overlay, and then preview, edit, and export the resulting video in formats such as MP4, WebM, MOV and MKV. Recording and video processing take place locally on your device, as described in our Privacy Policy.

Some features of Browser Recorder are available free of charge, while certain features require a paid licence. We may add, change or remove features over time. We do not guarantee that any particular feature will always be available.

Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and have the legal capacity to enter into a binding contract, in order to use the Services or make a purchase. By using the Services you represent and warrant that you meet these requirements.

Sign-In and Accounts

Some features allow you to sign in using Google OAuth. You are responsible for maintaining the security of the Google account you use to sign in and for all activity that occurs under it. You agree to provide accurate information and to notify us promptly of any unauthorised use. We are not responsible for any loss arising from your failure to keep your account credentials secure.

Licence to Use Browser Recorder

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and use Browser Recorder for your personal or internal business use.

Paid licences for Browser Recorder are sold as a one-time purchase that grants you a perpetual ("lifetime") licence to use the paid features, subject to these Terms. "Lifetime" refers to the lifetime of the product and does not constitute a guarantee that the Services, or any specific feature, will be offered or supported indefinitely.

Licence Restrictions

Except as expressly permitted by these Terms or by applicable law, you must not:

  • Sell, resell, rent, lease, sublicense, distribute or otherwise commercially exploit the Services or any licence key;
  • Share, publish or transfer your licence key to any other person, or use a licence key you did not lawfully obtain;
  • Copy, modify, translate, or create derivative works of the Services, except to the extent this restriction is prohibited by applicable law;
  • Reverse engineer, decompile or disassemble the Services, or attempt to derive their source code, except to the limited extent permitted by mandatory applicable law;
  • Circumvent, disable or interfere with any licensing, security or technical protection mechanism, or remove any proprietary notices;
  • Use the Services for any unlawful purpose, or in any way that infringes the rights of others or violates these Terms.

Purchases, Pricing and Payment

Paid licences are offered as a single, one-time payment with no recurring charges. The features included, the price and the applicable currency are shown at the point of purchase.

Payments are processed by our authorised reseller and Merchant of Record, Lemon Squeezy. When you make a purchase, Lemon Squeezy handles the transaction, billing and applicable sales taxes or VAT, and your payment is subject to Lemon Squeezy's own terms and privacy policy in addition to these Terms. We do not collect or store your full payment card details.

We may change our prices from time to time. Price changes do not affect licences you have already purchased. You are responsible for any taxes that are not collected by the Merchant of Record where required by law.

Refunds and Cancellation

We offer a 14-day money-back guarantee on paid licences. If Browser Recorder is not the right fit for you, you may request a full refund of the licence price within 14 days of your purchase, with no questions asked, provided that you are the original purchaser. Approved refunds are issued through Lemon Squeezy, our Merchant of Record, to your original payment method.

Please note that taxes or transaction fees collected at checkout may not be refundable in all cases, and that once a refund is issued your paid licence ends and your access returns to the free version of the extension. Full details are set out in our Refund Policy.

This guarantee is offered in addition to, and does not limit or exclude, any statutory refund or consumer rights you may have under the mandatory laws of Poland, the European Union, or your country of residence.

Right of Withdrawal (EU/EEA Consumers)

If you are a consumer in the European Union or European Economic Area, you generally have the right to withdraw from a distance contract within 14 days without giving a reason, in accordance with the EU Consumer Rights Directive and the Polish Consumer Rights Act (ustawa o prawach konsumenta).

Browser Recorder licences are supplied as digital content that is made available immediately. By completing your purchase and obtaining immediate access, you expressly request that performance begins immediately and acknowledge that you therefore lose your right of withdrawal once supply of the digital content has begun, to the extent permitted by law.

Your Recordings and Content

You retain all rights to the recordings and content you create using Browser Recorder. We do not claim ownership of your recordings and, as explained in our Privacy Policy, recordings are created and processed locally on your device and are not uploaded to or stored on our servers.

You are solely responsible for the content you record and for how you use it, including ensuring that you have all necessary rights and permissions.

Acceptable Use

When using the Services, you agree that you will:

  • Comply with all applicable laws and regulations, including those relating to recording, privacy, data protection and intellectual property;
  • Obtain any consent required from other people before recording them, their voices, or their screens;
  • Respect the rights, privacy and confidential information of others, and follow any policies that apply to content you record;
  • Not use the Services to record, store or distribute unlawful, infringing, harmful or harassing content;
  • Not use the Services to introduce malware, or to disrupt, damage or gain unauthorised access to any system or network.

You are solely responsible for your use of the Services and for any content you record. We are not responsible for how you use the Services or for any consequences arising from your recordings.

Intellectual Property

The Services, including the Browser Recorder extension, the website, software, design, text, graphics, logos and the "Browser Recorder" name, are owned by the Provider or its licensors and are protected by intellectual property laws. All rights not expressly granted to you are reserved.

These Terms do not grant you any right to use our trademarks, logos or brand features without our prior written permission, except as part of normal use of the Services.

Third-Party Services

The Services rely on or interact with third-party services, including Google (for sign-in), Lemon Squeezy (for payments), and Sentry (for error monitoring), as well as any websites you choose to record. We are not responsible for third-party services, and your use of them may be subject to their own terms and privacy policies. We do not endorse and are not liable for any third-party content or websites.

Disclaimers

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Services will be uninterrupted, timely, secure, error-free, or compatible with any particular device, browser version or website, or that any recordings will be free from defects or loss. You are responsible for keeping your own backups of any recordings that are important to you.

Limitation of Liability

To the fullest extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or recordings, arising out of or in connection with your use of, or inability to use, the Services.

To the fullest extent permitted by applicable law, our total aggregate liability arising out of or relating to the Services or these Terms will not exceed the total amount you actually paid us for the relevant licence, or, where you have not purchased a licence, EUR 20.

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any statutory rights of consumers that cannot be excluded or limited by law.

Indemnification

To the extent permitted by applicable law, and except where you are acting as a consumer, you agree to indemnify and hold harmless the Provider from any claims, damages, liabilities and expenses arising out of your misuse of the Services, your content, or your breach of these Terms or of any applicable law.

Suspension and Termination

We may suspend or terminate your access to the Services, including any licence, if you materially breach these Terms or use the Services unlawfully. Where reasonable and permitted by law, we will give you notice and an opportunity to remedy the breach.

You may stop using the Services at any time by uninstalling the extension. Provisions that by their nature should survive termination, including those on intellectual property, disclaimers, limitation of liability and governing law, will continue to apply.

Changes to the Service and These Terms

We may update these Terms from time to time. We will post any changes on this page and revise the "Last Updated" date above. If we make material changes, we will provide reasonable notice as required by law. Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.

Governing Law and Disputes

These Terms and any dispute arising out of or in connection with them are governed by the laws of Poland, without regard to conflict-of-law rules. If you are a consumer, you also benefit from any mandatory provisions of the law of the country in which you reside, and nothing in these Terms deprives you of that protection.

Any disputes will be subject to the jurisdiction of the competent courts of Poland. If you are a consumer in the European Union, you may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr, or contact your local consumer protection body.

General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right. You may not assign or transfer these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Services.
